Cheating Spouses And Alimony

In order to be granted alimony, the receiving spouse must be dependent on the other spouse for maintenance and support. However, if one party can show proof of the other party’s infidelity, the alimony decision may be affected. If the dependent spouse is unfaithful, he or she will not receive alimony. If the spouse with the alimony obligation cheats, the other spouse may be entitled to a higher amount of alimony.

It is best to secure direct evidence of the adultery, but if that is not possible, you may prove inclination (affection for another person) and that there was an opportunity for adultery to happen. This may include evidence such as public displays of affection, gifts from one party to the other or showing that they were in the same place together. We may hire a private investigator to do surveillance and collect this type of evidence before taking action in court.
