Driving without a license

In North Carolina, the penalty for driving without a license is considered a Class 3 misdemeanor for any person. This offense may be committed by drivers whose licenses have been suspended or revoked, or by people who never had a driver's license in the first place. The specific penalty for each offense may vary depending on the reason a license is not produced by the driver.

According to the National Conference of State Legislatures, the first offense for driving with a suspended license generally results in a $200 fine and an additional year of suspension. Punishments then increase for each subsequent offense. The second time a driver is found operating a vehicle with a suspended license, he or she may receive two more years of suspension. Those who are caught driving without a valid license for the third time face the possibility of losing their licenses permanently.

The News and Observer reports that there may be more serious repercussions for drivers who are not eligible to receive a driver's license in the first place. One requirement for obtaining a license legally within the state is having a Social Security number. People who are unable to produce that form of identification in order to get a license, but choose to drive anyway, may be charged a larger fine the second time they are caught, and they may even be sentenced to jail upon their third offense. This jail time could last up to 60 days. Additionally, the authorities may choose to seize the driver's vehicle.
