5 Questions To Ask A Personal Injury Attorney

If you or a loved one has been injured due to the negligence of another, you almost certainly have a lot on your mind - recovering from your injuries, paying for medical treatment, planning for your future. Another important thing to think about is hiring a personal injury attorney to represent your interests - an act which may, in fact, actually help relieve some of the burden, pressure and stress you are under.

Personal injury law covers a wide range of cases - from car crashes and bike accidents, to slip-and-fall incidents and dog bites. Personal injury attorneys often concentrate on specific areas of law and have strengths in certain facets of that law. Some have reputations for chasing ambulances, while others take their cases seriously and make the time to know their clients and their needs.

When you need a personal injury attorney to stand up for your rights, you'll want to make sure the attorney you choose shares your values and beliefs. Here are five important questions you should consider asking when interviewing a personal injury attorney:

1. What sort of experience do you have with cases like mine?

One of the most important things you will want to find out is how much experience the attorney has - and even more specifically, how much experience they have with cases like yours. Asking about similar cases they have handled in the past - and their success with those cases - can help you get important information you can use to decide whether they're the right attorney to represent you in court. It can also help you determine whether they are skilled in their field of practice, or whether they are new to the field or only dabble in personal injury law part time.

2. How many cases are you and your firm currently handling?

It is not uncommon for attorneys to handle a number of cases at once. The important thing to determine is whether your attorney is overburdened with a massive workload - you do not want them to be so busy, or overwhelmed, that they do not have the time or desire to give your case the personalized attention it demands. Make sure the attorney you choose will be able to devote the time, energy and effort necessary to get you the compensation you deserve.

3. What are your fees and how do you charge for your services?

Most personal injury attorneys charge on a contingency fee basis - which means they will take a percentage of any settlement or verdict they obtain on your behalf. This percentage may vary, so ask what it is. Also ask about whether there are any incidental fees or surcharges. Many law firms will charge for copying costs and other administrative fees, which is fine and legit, but it's good to know about this in advance.

4. Should I talk to the insurance company or will you deal with them?

Following an accident in which you've been injured due to the negligence of another, you should never talk to an insurance company without first talking to a lawyer. Insurance companies are typically not your friends in these situations - they are looking to get quick statements which are designed to save them money at your expense. A good personal injury attorney will act as a buffer between you and the insurance company and deal with them on your behalf.

5. What can I expect?

It's okay to ask an attorney what you can expect in your case. Although many personal injury cases are handled in a similar fashion, it's still import to ask what you can expect from their service. How much contact time will you have with your attorney? What should you do if you need to speak to them in person or on short notice? How long will it take to resolve the case, and should you expect to go to trial? An ethical attorney will never promise you a particular result, but it is a good idea to get a feel for how your attorney will approach your case - and what you can expect based on this approach.

No two personal injury attorneys or firms are exactly alike. When interviewing potential personal injury attorneys, make sure you ask questions like these - as well as any other questions that will help you determine whether the attorney is right for you and your situation.
